1. Agreement to Terms

By accessing or using AutoCuts ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Service. AutoCuts provides an AI-powered video editing platform that processes user-uploaded media.

2. User Content and Ownership

  • Your Ownership: You retain all of your ownership rights in your videos, audio, and materials ("User Content") that you upload to the Service.
  • License to Process: By uploading User Content, you grant AutoCuts a worldwide, non-exclusive, royalty-free license strictly to use, copy, reproduce, process, adapt, and modify such User Content solely for the purpose of providing the Service to you (e.g., transcribing, cutting, and rendering).
  • Responsibility: You are solely responsible for your User Content. You represent and warrant that you have all necessary rights, licenses, and permissions to upload the content and that the content does not infringe on the intellectual property rights of any third party.

3. Acceptable Use

You agree not to use the Service to upload, process, or distribute content that:

  • Is illegal, threatening, abusive, harassing, or promotes violence.
  • Contains extreme gore, non-consensual sexual content, or child exploitation material.
  • Infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights.
  • Contains software viruses, malware, or any other computer code designed to disrupt the Service.

AutoCuts reserves the right, but is not obligated, to monitor User Content and suspend or terminate accounts that violate these terms.

4. Credits and Billing

  • Credit Usage: Processing, analyzing, and rendering videos requires AutoCuts credits. The amount of credits consumed depends on the duration and complexity of the processing workload.
  • Purchases: All purchases of credits are final. Credits are non-refundable and hold no monetary value outside of the Service.
  • Expiration: Unless explicitly stated in a subscription plan, purchased credits may expire if the account remains inactive for a period of 12 consecutive months.

5. Disclaimer regarding AI and Outputs

AutoCuts utilizes artificial intelligence and machine learning algorithms to generate transcripts, detect pacing, and suggest edits. You acknowledge that AI is probabilistic and the outputs (the "Edits") may occasionally be inaccurate, incomplete, or inappropriate for your specific use case. It is your responsibility to review all Edits in the provided workspace before rendering and exporting the final video. AutoCuts makes no warranties regarding the absolute accuracy of the automated edits.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUTOCUTS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. As-Is Provision

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease and your User Content may be deleted.
